What is a judgment lien?
A court-issued claim against a debtor's property arising from a civil judgment. The creditor obtains a judgment in court for unpaid debt, then files a notice with the county recorder to create a lien on the debtor's real or personal property in that county.
Where are judgment liens filed?
In the county recorder office of any county where the debtor has property. To attach to property in multiple counties, the lien must be filed in each county separately.
How long does a judgment lien last?
State-specific. Typical: 5-10 years initially, renewable by court order for additional periods. Some states allow renewal indefinitely; others have hard caps. We report the renewal status.
Does a judgment lien survive bankruptcy?
Depends on the type of lien and the type of bankruptcy. Generally, a properly perfected judgment lien on the debtor's property survives Chapter 7 discharge as a lien on the asset (though the personal liability is discharged). Chapter 13 plans can strip undersecured liens. Critical for M&A buyers and real estate buyers.
How does this differ from a tax lien?
Tax lien: filed by the IRS (federal) or state revenue department (state) for unpaid taxes. Judgment lien: filed by a private creditor after winning a civil judgment. Both are filed with the county recorder in most states, but they are different types of liens.
