What is nexus?
The connection between your business and a state strong enough to require sales tax collection. Three main types: economic (revenue/transaction threshold), physical (inventory, office, employees), marketplace (sold via Amazon, Etsy, etc.).
What changed in 2018?
South Dakota v. Wayfair allowed states to require out-of-state sellers to collect sales tax based on economic activity alone. Most states adopted $100,000 or 200-transaction thresholds.
Does this apply to SaaS?
In 19+ states, SaaS is taxable. The list grows. Software-as-a-service falls under sales tax in states like New York, Pennsylvania, Texas, and Washington.
What about Amazon FBA inventory?
FBA inventory in a warehouse creates physical nexus in that state. This is true in most states, regardless of your revenue level.
Marketplace facilitator laws?
Most states now require marketplaces (Amazon, Etsy, eBay) to collect sales tax on behalf of sellers. You may not need to register in marketplace-facilitator states if you only sell there via the marketplace.
What if I have not been collecting?
